FIVE OAKS HOA ANNUAL MEETING - OCTOBER 27th, 2011

COVENANT CHANGES
The Five Oaks Homeowners’ Association is working to change the DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR FIVE OAKS with regards to certain items. Original ballots were mailed in November 2010. We have only had 50% of the homeowners respond with ballots. A second set of ballots will be mailed in January 2011 to those homeowners who did not vote. We are asking you to respond by February 15th. A vote of 75% of all property owners is required to change the Covenants and Restrictions. If we do not receive the votes by mail, we may have to visit you in person to obtain your ballot response.

The Five Oaks board members recently noticed a garage sale in the neighborhood. The board would like to emphasize that having a garage sale is a violation of the Covenants, Article X, Home Occupation. Below is an excerpt from the Covenants and Declarations. Homeowners that violate the Covenants will be subject to fines.
"The proposed uses shall not generate noise, odor, fumes, or smoke, nor create a nuisance of any kind which would adversely affect the residential character of the Development;
No traffic shall be generated by the home occupation in greater volume than would normally be expected in a residential neighborhood;
As most of you know, speeding has been an issue in FiveOaks for a long time, especially on Five Oaks Blvd. This isespecially noticeable when walking with our children or evenwith our pets. And without sidewalks, it can be a challenge. Your HOA is working to do what we can to address these unsafe conditions. The board has met with Jeff Baines, Lebanon Commissioner of Public Works and Kathy Warmath,the Lebanon City Councilperson for our area. Our original intent was to add more stop signs but we are going to try some less evasive techniques first.
1. We added 4 additional speed limit signs.
2. We added rumble strips on Five Oaks Blvd. just as you cross over the bridge.
3. We asked the police department to increase patrols in the neighborhood to reduce the amount of speeding.
4. Two speed bumps have now been installed on Five Oaks Blvd., along with signage pertaining to the bumps.
In July 2008, we sent all lot owners a letter indicating the Five Oaks Homeowners Association intention to enforce the two (2) year time limit for house construction. The legal document governing the FiveOaks Homeowners Association, DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTION FOR FIVE OAKS, states that "construction of the primary residence on a lot shall be completed within two (2) years of the initial purchase of such lot from theDeveloper." The HOA does still intend to enforce the Covenants with regard to the matter, however, the board has voted on a newinterpretation of the clause within the Covenants. The word "Developer" was always understood to mean the original developer of the subdivision, The Farm. However, with the new interpretation, the "Developer" can now mean anyone who bought the lot with the intent of developing it.
Therefore, if a lot owner chooses to sell their lot, a new two (2) year time frame to build will begin for the new lot owner. And each subsequent owner, if any, will have a fresh two year period to begin construction. For current lot owners who do not intend to sell their lots, the July 2010 deadline to begin construction still applies.
The board voted in August 2010 to modify the fine structure for the 2 yr construction violation due to the economic climate in the housing market. The board has reduced the fine to $50/mo. and has also deferred payment until the lot sells or a home is built. There is no time frame on the deferment period. The board voted to suspend the fine for the 2012 year.
